PRODUCT DESCRIPTIONS
We attempt to be as accurate as possible in our descriptions, photographs and related media. However, we do not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered and manufactured by Sandstone Specialty Awards itself is not as described, and the error is not found before the item is shipped, customer's sole remedy is to return the item in unused condition following requirements as set forth in our return policy. If there is an error in a product listing, and we find the error before the item is shipped, we reserve the right to notify the customer of the error and give the customer the choice of either 1) canceling the order; 2) paying the difference in price, or 3) in the case of multiple items on an order, deleting that item from the order.
RISK OF LOSS
All items purchased via Sandstone Specialty Awards websites are made pursuant to our shipment policy. You agree that the risk of loss and title for such items pass to you upon our delivery to the carrier.
SALES TAX
We are required to charge applicable sales tax on products shipped to jurisdictions that levy sales tax in which we have a physical location. Currently that only includes the state of Washington.
INDEMNITY
You agree to indemnify, defend and hold harmless Sandstone Specialty Awards, its owners, and/or officers, directors, employees, and agents, from and against any claims, actions, or demands, including, but not limited to, reasonable legal and accounting fees, arising or resulting from your use our websites or your breach of these terms and conditions of use.
JURISDICTION AND VENUE
If litigation is necessary to enforce this agreement, the jurisdiction shall be a court of proper jurisdiction in Whatcom County pursuant to the laws of Washington in force on the date of signing. The prevailing party shall be entitled to all legal costs, including but not limited to; court costs, attorney's fees, service fees, filing fees and all other costs associated with litigation.
APPLICABLE LAW
This Agreement and the rights and obligations of the parties hereunder shall be governed by and interpreted, construed and enforced in accordance with the laws of the State of Washington (regardless of the choice of law principles of Washington or of any other jurisdiction).
DISCLAIMER OF WARRANTY
THE MATERIALS CONTAINED ON ALL SANDSTONE SPECIALTY AWARDS WEB WEBSITES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED.
